No Further Action for University Student Accused of Serious Sexual Assault

Following pre-charge intervention, PCD Solicitors have secured no further action of an investigation whereby our client was accused of sexually assaulting a fellow student by digital penetration, contrary to section 2 of the Sexual Offences Act 2003. A serious offence which carries a maximum of life imprisonment. 

PCD Solicitors were contacted by a 20 year old student, a lengthy discussion took place with a member of our team who discussed the allegation in depth with the client. Following our advice in relation to the law and procedure at the investigative stage of the case the client went ahead and instructed for us to act on his behalf. 

Time is of the essence during a police investigation and work began immediately on this case. The case was assigned to Jessica Wilson who initially made contact with the senior investigating officer as part of pre-charge engagement. Jessica received full disclosure of the complaint from the police and was able to discuss this with the client. Following this representations were drafted and submitted to the RASSO (Rape and Serious Sexual Offence) unit of the CPS (Crown Prosecution Service). As a result within 5 weeks from instruction, the case against our client was discontinued due to lack of evidence. 

This case came down to one persons word against another, the complaint was made by a woman who the client accepted being in a sexual relationship with. The client did not dispute sexual contact with the woman however, maintained this was consensual. 

Consent is a full defence to an offence under section 2 of the Sexual Offences Act 2003. Where it can be shown that the complainant consented to the sexual penetration the suspect cannot be charged/convicted of the offence.
